How long do I have to file an injury claim with a businesses medical insurance company?

Answered by attorney Josh Lamborn (Unclaimed Profile)
Personal Injury lawyer at The Law Office of Josh Lamborn, P.C.
You have two years from the date of the incident to settle or file a personal injury lawsuit in Oregon. After that your cause of action is barred by the statute of limitations. In some cases you may have more or less time depending on the facts. Also if the defendant is a public body you may have to file a tort claim notice within 180 days.

Can I sue for pain and suffering after a dog attack?

Answered by attorney Richard Everett Damon (Unclaimed Profile)
Personal Injury lawyer at Richard E. Damon, P.C.
Yes, you can sue for your pain and suffering provided you have not already signed a release in exchange for the payments you have already received. The amount for pain and suffering depends on all the circumstances, especially the severity of your injury, but it could be in the many thousands of dollars. No attorney can tell you without a thorough review of all the facts and documents just how much your case is worth. The property owner is probably not liable, but he/she may have insurance that would cover your injury.

Can I sue over my baby's injuries?

Howard Dale Mishkind
Answered by attorney Howard Dale Mishkind (Unclaimed Profile)
Personal Injury lawyer at Mishkind Law Firm, Co., L.P.A.
I would be happy to help you. I hope you have pictures of your baby's injuries. Assuming that the facts are as you have described them, the restaurant is liable for the medical bills , the scarring and burns and the pain and suffering caused to your baby. You should talk to an attorney before doing anything else but it sounds like you have a very proper claim.
