How should I go about suing the driver of the truck that hit my car and tried to run?

Answered by attorney Barry Ronald Rabovsky (Unclaimed Profile)
Personal Injury lawyer at Law Office of Barry R. Rabovsky
Since you did have medical treatment, it would be possible to pursue an injury claim. The first thing to do would be to get a copy of the police report to see who to make a claim against and to obtain insurance information.

If we got food poisoning at a restaurant and had to go to the emergency room, is the restaurant liable for the hospital bill?

Answered by attorney Robert Andrew Michael Burns (Unclaimed Profile)
Personal Injury lawyer at Law Office of Robert Burns
The restaurant would be liable if it had no-fault insurance for such a medical expense but would be liable for all actual damages only it breached a duty to avoid food contamination and such contamination caused the illness. It does look like food poisoning is provable and that undercooking of the chicken was provable. Still that chicken needs to be linked up to the food poisoning. The chicken may have been received at the restaurant excessively toxic and/or wrongfully stored and prepped so as not to mitigate/avoid toxicity.

Can you settle with the insurance company if you had rear ended auto collision?

Mark Joseph Leonardo
Answered by attorney Mark Joseph Leonardo (Unclaimed Profile)
Personal Injury lawyer at Dordick Law Corporation
You can always try to settle with the insurance company directly, but they undoubtedly will take advantage of your non-representation and low-ball you on an offer to settle. An attorney in all likelihood will get you more money, but then you have to balance out that fact with the deduction for paying attorney's fees. If they are minors it's usually 25% whereas most attorneys charge 33% for an adult.
