What are the possible remedies for me to ask for damages against the owner?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Personal Injury lawyer at Peters Law, PLLC
What you do is write a letter to the owner explaining the situation along with a copy of the dentist's bill for the repair. Nothing gets done with talking. You must put it in writing. Chances are the company's insurance company will give you a call and offer to pay the bill plus $500. Or some amount or another for pain and suffering. Keep the rock in a safe place because you may need it if you sue in small claims court.

Can I sue the doctor who misdiagnosed me and sent me home?

B. Casey Yim

Personal Injury lawyer at Murchison & Cumming, LLP
you need to contact an attorney right away. You have statute of Limitations ticking away; and fuse is short. Atty may also be required to obtain a medical expert before filing. Don't wait any longer.

Is small claims suit over a breach of contract worth even trying to sue over?

Small Claims Court does not charge much for opening a case, and you do not need an attorney to present your case to the court. Whether it is worth your time is your decision. You can ask for damages that include a) all the money you paid to the defendant b) all the money you spent on materials c) the difference between the original contract price and the amount you ended up paying to have satisfactory counters d) all other losses you can prove (for example, the wages lost due to the need to be home at request of the defendant) Remember that Small Claims Court cannot award you more than $5000.
