How can I file for a personal injury suit?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
While you can pursue a claim for assault and battery on your own, I would highly recommend that you consult with an experienced personal injury attorney first. Since this was an intentional act, it will most likely not be covered by their homeowners insurance. Unless these people have significant liquid assets, you may spend almost $500 in filing fees and service of process fees only to obtain a judgment which would not be collectable. Perhaps if you were to meet with a good, experienced personal injury attorney, he or she may think of a way to frame your cause of action in negligence, so that the homeowner's insurance would cover your medical bills at least. Since the incident occurred on their property, their medical payments coverage might cover your medical bills up to the limit of their med pay coverage, but I would still consult with an attorney first so that you don't jeopardize whatever possible homeowners coverage there may be.

Can I sue the photographer if I have tried to contact her and she never got back to me?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
You probably cannot sue for the Facebook give away. You may be able to sue for the 1 hour you didn't get. It depends on the agreement you made. If it was a flat fee to shoot your wedding based on an estimated 7 hours, then she has a right to keep the entire fee regardless of her offer to give a free hour. If you were paying by the hour and pre-paid 7 hours, I suppose you could sue for the hour you didn't get.

Can I still press charges against a person after 3 years or is it too late?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
First of all, it isn't up to you. You already said that the police refused to press charges, but then you said that you were both issued tickets, which means that charges were in fact brought. If they didn't take action then, what makes you think they would do so now?
