I waited 26 days to notify the premise owner of my fall are they still liable?

The fact that you waited 26 days to notify the Gym is not relevant from the standpoint of liability. If you can prove negligence on the part of the Gym, they can be held liable for your injuries. As an aside, these outfits always deny liability. Don't give them any recorded statements. Don't sign any medical releases. Don't talk to their insurance adjusters. File suit and go from there.

An interesting question. If you can prove that you were injured, meaning that you were made worse off than you were before, the statute of limitations in NY would run three years from the point of failure, if you can prove when that was. If you are suing for the replacement, I think that would be a breach of warranty and the limit for that is four years from the date of delivery.

Were you supposed to be up and about? If so, and unbalanced, I guess it could be negligent to not get someone some crutches...but it's not the world's most exciting case. I had foot surgery and hopped around my house on one foot. If I had fallen and hurt myself it would have been my own damn fault.
