In Michigan, when you are in a car crash, your own car insurance company will pay your Personal Injury Protection (PIP) benefits. These consist of any wage loss @ 85% of your gross wage; your related medical treatment costs; and any required household help a/k/a replacement services. There are 3 year time limits on the wage/help benefits, but lifetime benefits re: medical care, treatment and testing. Thus, none of this has anything to do with a claim vs. the other vehicle owner/driver. You may also make a so-called 3rd party claim against the other vehicle owner/driver if you can prove their negligence in causing the crash, the proximate cause of any injuries you claim to the crash event and if you sustained threshold injuries of a serious impairment of a body function and/or permanent, serious disfigurement.

Unfortunately, you will be limited to the fair market value of your vehicle immediately prior to the impact. The fact that your vehicle recently had four new tires and a completely new air condition system, however, will add overall value to your vehicle. You may need an appraiser to give you an opinion about the fair market value of your vehicle. Unfortunately this number will not include the car payments that you'll have to make on a new vehicle. If you used your vehicle for your business, however, you may also be able to recoup loss-of-use value in addition to the fair market value of your vehicle.

Depends on a lot of things. You say you were traveling at 45 mph at an intersection. What was the speed limit? If the speed limit was 45 then maybe you should have been traveling a little slower and being a little more careful (that may be the insurance position) if the other driver says you were driving too fast you could lose the case entirely. In NC you must be totally free of any degree of fault to get anything. Next question: what is the insurance coverage? Do you know? How could you possibly demand a figure if you don't know the coverage? Does the other driver have any assets beyond the insurance? In other words can he afford to lose the case to you big time? if he doesn't have anything to speak of it is urgent you find out coverage. Did you ask?sounds like you have a lot of big time injuries. The sky is the limit. If you had a proper PI lawyer you might be asking about degree of permanency, future medical expenses, future care of all sorts. Get you a good lawyer to review all this with you. I can assure you that you are not able to do this yourself. I cant imagine why you would try except to avoid attorney fees which may cost you the whole ballgame. Get you some proper professional help.
