That is not a question I can answer, but what I would do is contact an attorney who handles a lot of medical malpractice cases, and if he's willing to take your case, he will pay to have a physician review your medical records to determine whether the doctor deviated from the standard of care.

The jury would weigh the testimony of each witness, and unless the sheriff/policeman/trooper actually saw the accident, he wouldn't be allowed to testify. In Florida, whether someone was cited with an accident by a law enforcement officer is not even admissible.
