I was helping a family member at their house cutting some zip ties off a slide and slipped I cut major artery and tendons. What can I do?

Answered by attorney Stephen Arnold Black
Personal Injury lawyer at The Law Office of Stephen A. Black
OK, I'm really sorry about this incident. I hope you get better. So there is no automatic liability if you were injured on another person's property. The injured party has to prove that their damages were caused by the negligence of the property owner or property manager, it does not appear from your fact pattern that they did anything negligent to cause your damages. If they do have a homeowners insurance policy, usually there's always a med pay portion that they will tender provided that a person was injured on the property and you suffered damages. However, that being said, you should still search for an attorney in Colorado as there could be liability based on some kind of clever argument that they gave you a tool that they knew or should've known was defective and you had no knowledge that this tool was defective. There could be other arguments you could make, but that's just one off the top of my head.

I waited 26 days to notify the premise owner of my fall are they still liable?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
The 26 days can be an issue because they can deny it happened, or they can argue that even if you fell in their lot, you could have been injured elsewhere. It will be an issue of who the court believes. However, the bigger issue is whether they are liable even if they agree that you were injured in a fall in their lot. They are no liable just because you slipped and fell in their lot. You must show that they were negligent in some way and that their negligence caused you to fall.

Is it too late to file a claim on an auto accident if it happened a month ago?

Answered by attorney Steven A. Schwartz
Personal Injury lawyer at Joel H. Schwartz, P.C.
In Massachusetts, the initial $2000 in reasonable and necessary medical bills is paid by the car insurance of the car you are in. This portion of the insurance policy is called personal injury protection benefits. It will also pay 75% of your lost wages, as well. Any medical bills above and beyond $2000 would then have to be submitted to any private health insurance you have. Have your doctor submit his/her bills and records to this insurance company. As far as hiring an attorney, I don't know how many you have talked to, but I would suggest you keep trying.
