If you were defrauded, you can sue to rescind the sale. You should make a written demand by certified mail or overnight delivery. You can tell the seller that you will sue for fraud and seek punitive damages for his misconduct if he does not immediately return the car and title that you traded. If he does not respond favorably, you can sue him.

This is really a dental question for a dentist to answer. Below is some general information regarding Dental Malpractice: To successfully sue for malpractice, you need three things: 1. Evidence that the dentist deviated from acceptable standards of due care, either by act or omission. This is also referred to as negligence. A bad outcome, in of itself, is not evidence of negligence. You need a dentist to testify that the doctor/nurse was negligent. 2. Evidence that the negligence cause some harm. 3. Significant damages. If the negligence caused minor damages, it would not be economically feasible to bring a malpractice case, because the cost in expert witness fees would exceed your damages. Some malpractice attorneys who require at least $500,000 in medical bills or lost wages caused by the negligence before they will consider the case.

You can get restitution through the criminal case and you can also apply for help with the Crime Victims Board. Google it or ask the ADA assigned to the case for information. Also, you can sue, civilly, for the intentional tort of assault but, typically have a 1 year statute of limitations. Hopefully, the attacker has assets otherwise, it may be pointless to sue them as you cannot get blood from a stone. Sometimes you can keep insurance coverage in the case but, they usually disclaim due to the intentional act exclusion. There are literally TONS of attorneys in Buffalo that do this. Do a Google search and you'll find a bunch or contact the Erie County Bar Lawyer Referral Service or New York State Bar Lawyer Referral service. They both are available online. Good luck and I hope you heal well.
