Under the Uniform Commercial Code, there is an "implied warranty of merchantability" meaning that you have a right to get what you paid for, a phone that works. Obviously, a phone that is too hot to handle is no good. Return the phone and demand your money back.

Actually, you can call the police. They may decide not to bring charges since he is overseas, but they might issue a warrant in the event he is ever in the area. Also, individuals can be extradited from some foreign countries, but it is unlikely law enforcement authorities would do so on such a relatively minor crime. If you can't do the work, they have the right to dismiss you and hire someone who can do it. But, you are still entitled to you worker's comp coverage.
