If the case was filed within the statute of limitations for the tort alleged (in this case, the tort is probably negligence), then her claim for pain and suffering is not barred. In Mississippi, the statute of limitations is 3 years for a negligence claim (unless its against a governmental entity) so her 4 year old claim would be barred if the case was in Mississippi. However, statutes of limitations are a state by state kind of thing, so it will depend on the length of the statute of limitations for negligence in the state where the case is filed.
