Probably not. You need to prove that something the homeowner did was careless and caused your injury. Doesn't sound likely with a bicep tear. However, the HO may have medical payments coverage in his policy that pays medical expenses without having to prove liability. Usually limited to 1K to 10K if it is a good company.

While you did not state so in your inquiry, I am assuming this occurred at work. In Florida, your exclusive remedy against your employer is to make a workers' compensation claim unless the conduct of your employer was so egregious that harm was highly likely to occur to you. With that being said, if the equipment was unsafe, perhaps you can make a products liability claim against the manufacturer of the equipment. I think you should check with a good workers compensation attorney quickly.

Your insurance company must hire their lawyer for you and pay costs of defense. If the biker wants any money from the insurance company he must sign a release that releases you entirely. Call your insurance agent or company and they should explain your rights in more detail and answer your questions.
