You may have a personal injury case against Walmart.  A store owner is required to provide reasonably safe premises for its customers.  If the boxes fell because they were improperly stacked or because of some other reason unrelated to anything you or your daughter might have done to contribute to the incident then the store could be held liable for negligence.  There are many factors that have to be considered.  A personal injury lawyer will be able to evaluate the facts to determine the strength of a case against Walmart.  I recommend you contact a lawyer to determine if a claim should be made against Walmart.    Michael J. If proven, I'd think that this would constitute aggravated negligence. But, without video or witness your situation seems unusual enough as to not have been apparent nor reasonably preventable to the hotel. You'll need to develop more information to be able to gauge the viability of your damages claim.

In order to prove a medical malpractice case, a claimant must prove a failure to conform to accepted practice, resulting in an injury. A bad result is not enough. You will need to get copies of ALL of your medical records and have a doctor review them; if he/she is willing to testify that the doctor or hospital failed to conform to accepted practice, then you have a case. "Pretty sure" that the infection was aquired in their facility is insufficient, and what could have happened but did not is of no consequence. These cases are difficult, time consuming and expensive, so even if you do have a case, you will be dealing with it for several years.
