What do I do if I received a subpoena but I can't go?

Bradley Williams Cornett
Answered by attorney Bradley Williams Cornett (Unclaimed Profile)
Personal Injury lawyer at Ford, Howard & Cornett, P.C.
You are not at liberty to ignore a lawfully issued and served subpoena. You should contact the attorney who had the subpoena issued and make appropriate arrangements. Most attorneys will work hard to accommodate a witness. If that does not work, you should call the judge, explain the situation respectfully, and request reasonable accommodation. If absolutely necessary, you may need to hire an attorney to file an objection to the subpoena and request that the subpoena be quashed. Keep in mind that "I'm busy" or "my boss will be mad if I miss work" or "I have a baby" or "I can't afford to miss a day of work" are not grounds to quash a lawfully issued and served subpoena. If you were hurt in an accident (or wrongfully accused of hurting someone in an accident), you would want witnesses to cooperate. Do unto others as you would have done unto you.

Is $100,000 the max I will get if the girl has 100,000/300,000?

Answered by attorney John F Turck (Unclaimed Profile)
Personal Injury lawyer at Blaske and Blaske PLC
$100,000 is the maximum you can get from her insurance policy in a third-party claim against her. If she has assets, there is a possibility you could collect from those assets, although that is probably unlikely. The medical bills should not be paid out of the $100,000 policy she has, as you may know. Those medical bills should be the responsibility of your No-Fault insurance carrier, in a first-party claim. I'm happy to talk about it with you if you'd like, but I will count on you to contact me further if you'd like to do that.

What should I do if an attorney is trying to overcharge me for an auto accident case?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Personal Injury lawyer at Bulman Law Associates PLLC
Your story is all mixed up. If you have worker's comp insurance, why would your health insurance even come into play? Call Lawyer a and ask for any accounting of the way the settlement will be divided. If they are paying some of your outstanding bills as a part of the settlement or costs they incurred in preparing your case, then this scenario looks typical. The lawyer offered a fee reduction so pay the woman. Take your $6k and pay down your credit cards.
