Can a Real Estate attorney get a fair and just settlement on a car accident?

Perhaps yes and perhaps no. This will depend on whether the attorney knows the fair value for such a case and whether the other side tries to gain some advantage because they believe the attorney may not know the fair value. You can always get a 2nd opinion from a lawyer that handles more car crash cases.

Can I sue the other driver if they were at fault?

You are entitled to be compensated for your loss. Your insurance company has determined that the value of the car is less than what you thought it was. You can try to sue the driver of the other vehicle for the difference, but you will have to produce documentation as to the value of the car.

Can I sue him for something other than medical bills and my car like emotional distress?

In Michigan you must have so-called "threshold" injuries in order to sue the owner/driver of a negligently operated vehicle for damages. You do not need threshold injuries to sue under the Dramshop Act if a liquor establishment continued to serve the intoxicated person after they were visibly intoxicated. However, you do need damages to be entitled to compensation, and the less the damage, the less the value of the case (and the less the value, the less likely an attorney can reasonably take your case).
