First, in Nebraska, a person cannot collect punitive damages, which is money paid to "punish" the person or company that did something wrong. Other states do permit a person to collect punitive damages. Second, there is no magic formula to determine what a case is worth. Each case is different and dependent on its owns facts and evidence. A person is entitled to be "made whole" or "compensated" for his or her injuries and damages. There are a number of factors that help determine what a case is worth, which include, but are not limited to: the nature and extent of the injury; medical expenses; whether an injury is temporary or permanent; lost wages; and pain and suffering. If an injury is permanent or will affect a person in the future, the person should receive additional money. Are you the defendant? If you are not there, and have been ordered to be there, a Judge could order a bench warrant to bring you to Court. If not, a judgment will be probably be entered against you and efforts to enforce that judgment will probably ensue shortly thereafter. Once you file bankruptcy, you will have to give the person who sued you notice of you bankruptcy and they will have to go to the bankruptcy court like any other creditor and make a claim and try to collect from you there.

I doubt it. You must be able to prove that the hospital knew or should have known that the pin was there and did not remove it in a reasonable time or warn you of its presence. This usually requires you to prove when and how the pin got on the floor or have a statement that meets your proof requirements. Virginia is a very difficult state to win a premise liability case.
