If the other driver has UM/UIM coverage, it should kick in to cover the difference. If you and your wife have any assets, there is a chance the adverse driver could sue you and get a judgment?then attach on your assets to satisfy the judgment. If you do not have assets, you may wish to execute a sworn declaration stating so and the driver may deem it not worthy to pursue an action against you.
