First, you cannot have anyone jailed. Only the police can arrest someone and only a judge can sentence someone to be held in jail after their arrest. You can only appeal the order to have it removed or sue and collect money for any wrongs committed upon you. Second, judges are protected by "immunity" for almost all judicial decisions they make. There is nothing you can do to the judge. Third, it is possible you may have a "malicious prosecution" or defamanation case against your spouse. To win a case for "malicious prosecution" you must prove all of the following: (1) that your spouse caused the restraining order proceeding to be filed against you; (2) that your spouse did not have probable cause for filing the proceeding against you; (3) that your spouse was motivated by malice; (4) that the case was a proximate cause of some damage to you; and (5) the nature and extent of that damage. However, to prevail on a claim for malicious prosecution you would have to prove that you did not do anything that warranted a no contact restraining order to be ordered against you. Without this, you cannot win a claim for malicious prosecution. For a defamation case a person must make a false assertion of a fact, not opinion. A statement must have some standard to measure to determine whether it is true or false to be defamatory. For example, if your spuse just said you were a "not a very nice person" that would not be defamatory as it would be an opinion rather than a statement of fact as it could not be proven true or false; each person would have their own opinion about what it means to be a "nice person." There are some statements automatically considered defamatory. To prove a defamation case, you must prove that the allegations your spouse made to the police are false. Second, the statements made by your spouse must relate to statements of fact rather than opinion. If your co-spouse said she felt "harassed" by you but could not point to an particular example, you may not have a claim as this would be more "opinion" than a "statement of fact." There are other things you must prove for you to be able to prevail in a defamation case but these are the two most important. Without you having the no contact restraining order revoked and prove that it should not have been issued, you likely do not have a claim against your spouse. You might want to talk to an attorney about what occurred and he or she could discuss your rights and options with you.
