No, it is too late to sue them. What you need to do is to keep them away from you. If they come on your property, have them arrested for trespass. Maybe eventually, they will understand that you don't want to see them.

Does the doctor say that it was in fact strep and that it was from the plastic? Any witnesses? Did you report this to the restaurant? I ask because there are unscrupulous people who would be willing to make such a claim falsely, and so franchises such as this are on the lookout. Unfortunately, that also means that some legitimate claims are denied.
