I gather that your ex-husband was the plaintiff in a personal injury suit that settled and you are unsure whether you were included as a derivative co-plaintiff.   It is unlikely you were included in that suit becuase if you were, then you would have had to approve the settlement and you would have been required to sign the general release (even if you were to receive no money).   For you to have been entitled to compensation you would have had to have pecuniary loss based upon your ex-husband's "services and society."  For that, the considerations are the things your husband would normally have done but that he could no longer do because of the injury.  This includes such things as his disposition, temperment, character and attainments, his interest in his home, the social life  of his family and the comfort, hapiness education and general welfare for the family members among other things.   Given the divorce, these claims are often difficult to prove and can lead to difficulties in prosecuting the case at all.  Meanwhile you can often see who was included by searching the court website for case dispositions.

A lawsuit for a personal injury can be filed in the State of New York any time within 3 years after the injury. The store's insurance company is not in the business of righting the wrong that was done to you; they want to keep every cent they can, and have a whole bag of lies and tricks for this purpose. This is why you are better off being represented by an attorney: even though you will have to pay for legal services, the sum you will recover is likely to be much closer to a decent compensation if you are represented by a competent attorney than if you try to act on your own.
