How do I determime amount of settlement without leaving money on the table?

Answered by attorney David Scott Carlile (Unclaimed Profile)
Personal Injury lawyer at Carlile Craig, L.L.P.
It is not possible to accurately predict your cases value without knowing more facts. First, you should hire an attorney. The insurance company will definitely try to low ball you if you represent yourself. In my experience a settlement of 2 to 4 times the medical is a reasonable range on a soft tissue case with no need for surgery and clear liability. Nevertheless, all cases are unique so that is just a range. The insurance company will have to disclose how much insurance is available on the policy. The minimum in Texas is $30,000 for a non-commercial vehicle. If the truck that hit you is a commercial vehicle or business vehicle, then there is likely a larger policy limit.

What can I do if my child was misdiagnosed by a doctor?

Answered by attorney Steven A. Schwartz
Personal Injury lawyer at Joel H. Schwartz, P.C.
The simple answer to your question is not much. Even if you could prove malpractice, that is, the doctor used substandard care with your son, the case would not be worth pursuing. In order to establish negligence, you would need to hire a medical expert that would cost thousands of dollars. You would have a 2 to 3 year litigation process that would be very costly. In the end, your son's pain and suffering would not be worth the cost of a lawsuit. Unfortunately, you must use an economic analysis with this and it just doesn't make sense for you to spend the time and money. I wish I had better news for you, and I am sorry to hear about your son's suffering.

If the victim of a car accident has medical bills that exceed the defendants auto policy limits, is there any thing additional that can be done?

Answered by attorney Stephen Arnold Black
Personal Injury lawyer at The Law Office of Stephen A. Black
no unless your brother has a UM policy or the at fault driver has assets that can be recovered. His counsel should prepare a letter demanding that the at fault driver execute an affidavit of all assets and liabilities under penalty of perjury and also provide your brother with several years of tax returns before he will sign a release that releases the Ins Co and the at fault driver Steve   Licensed in Fl and Tx
