The typical Florida Bar approved/Supreme Court approved contingent fee is 1/3 if settled without filing suit, 40% if a lawsuit becomes necessary and the defendant denies fault in its answer, and 45% if an appeal has to be taken from any ruling in the case. 45% is only appropriate if he had to take an appeal. Look at the original contingent fee contract you signed with this lawyer....that will show you what he would be charging you.
