This is a common problem and requires a lawyer who has the respect of a qualified surgeon to take the case on an LOP. At times that doctor will have a relationship with an outpatient center for the surgical/Operating Room part of the surgery. There are also hospitals and surgical facilities that work with companies who pay their fee up front and take their money on the back end. That will be based on the finance companies assessment of the case, which again, involves having the right lawyer.  Having said this, there are situations where liability is not clear, or the relation of the injury to the accident is not clear, or the at-fault person does not have enough coverage. In these situations, you and your lawyer need to hope someone will accept your health insurance. Public teaching hospital such as University of Miami, Jackson Memorial Hospital will take all insurance, but they have little interest in helping explain how the injury is related to the accident and are very conservative in terms of your even needing surgery.  Without knowing more it is hard to give you clear direction, but if you have an attorney that is who you should be asking these questions to. If you don't have a lawyer, you should hire one.
