Dental malpractice cases are always difficult to prove, as well as expensive and time consuming. You will have to be able to prove a failure to conform to accepted practice, and resulting injury as well, and expert witness testimony is required for that reason. In order to be able to pursue the matter, the consequences would have to be severe enough to merit a substantial enough recovery to justify the time and expense.

I?m not familiar with the term dislocated herniated disc? You might have a joint dislocation even between two vertebral bodies in the neck because of ligament damage. A herniated disc is where the nucleous propulsus pops out of the inside of the disc because the skin of the disc, the annulus fibrosis, is torn. This may well result in the disc materials pushing on a peripheral nerve root (going down the arm or the leg) or compression on the spinal canal. These injuries are always treated non-surgically at first, with P.T., Rx and sometimes steroid injections. The overall value of a herniated disc claim will vary depending, really, on whether or not the patient has surgery. Then, did the surgeon do a discectomy, or did the surgeon do a discectomy and fusion of two or more vertebral bodies. Straight forward one level disc herniations with fusion are worth at least 150K. The value may be more. It just depends on the amount of the medical bills, earnings loss, and the result of the surgery = good or not good. You ARE going to have a permanent impairment of some kind = motion or strength with this kind of injury. How old are you? What is your life expectancy? These are all factors. IT may come down to HOW MUCH insurance is available between the at fault driver and then your car insurance, too.

Standard operating procedure to request records. They can only be used for purposes of this claim. If you file suit against the driver of the other car they can subpoena the records as a matter of law. If you do not file suit you do not have to release the records but they do not have to pay your bills. In that case the ambulance, hospital and doctors will hold you personally responsible. I would release the records.
