If brand new car was hit by a drunk driver, how can I get a replacement car instead of having this car repaired?

Answered by attorney J. Michael End
Personal Injury lawyer at End, Hierseman & Crain LLC
You do not have an option. The insurance company has to pay you the lesser of the value of the car at the time of the accident, or the cost of repair. The cost of repair will be the lesser amount, so that is what you will get.

When they include future medical expenses in a settlement, how many years does this cover?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
There are published tables that show the statistical life expectancy of individuals in certain categories. So, for example if you are a white male who has reached the age of 38, you can expect to live another 37.4 years. If you are a black female of the same age, your statistical life expectancy is 38.6 years. There are other variables that can refine this further people who have a higher degree of education tend to live longer; people who are disabled have a shorter life span. In re-reading your question, though, I noticed something: you state that as far as the physical injury is concerned, all you have are some bulging discs. Has anybody told you that's no big deal? Most people over the age of 40 have at least some bulging discs. I probably have plenty of them and while I don't do extreme sports, I could give you lots of examples of my physical prowess. I've had at least one client who had a herniated disc (which is worse) which healed up with physical therapy. Also, there is a study that shows that people who have been injured and who have claims in litigation take a longer time to recover, so once you have that settlement, you can focus more on getting better. You state that you are going to a psychiatrist, chiropractor and physical therapist so it sounds like you are on the right track as far as that is concerned, but this gloom and doom stuff is doing you no good: "Preventing me from advancing", "totally destroyed my social life", "it's all ruined". With an attitude like that you will never get better. I know a PM&R doc who says to his patients: "I don't want to hear about what you can't do. I want to know what you can still do." So maybe you need a different psychiatrist, this one sounds like he just wants to keep you on drugs so he can keep billing you. Chiropractors live on patients who keep coming back, so maybe you should switch up to a PM&R specialist instead. There are many modalities of physical therapy, so maybe you just haven't hit on the right technique yet (aqua therapy works for some, traction is the answer for others, there is a considerable range available) talk to your PT about that. You also need some inspirational help, start by reading "Carry On!" by Robert Service print out a copy and scotch tape it to your bedroom door.

What should I do if my attorney backs out?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
You do not give much information. I do not know what the case is about, and I'm at a loss to understand what the attorney filling out paperwork to a lending company has to do with anything. I do not know what you mean when you say the attorney is saying "no". I do not know if this means he now thinks you will get less, now refuses to go to trial, or said he would help you get a loan or advance against your case, and now says no. If the attorney first told you he could get a 150,000, but now thinks he can get less, this makes sense. An attorney really cannot say with any degree of certainty what the outcome will be in the beginning, and as the attorney learns more through discovery, attorney's view of the case changes (usually downward rather than upward). For this reason, I usually avoid mentioning specific dollar figures at the beginning of the case. If he said he would help get you a loan, and now says no, he loan company may have thought your case was too much of a risk to loan money against. I recommend that you express your concerns with your attorney and see if he can help you understand whatever it is you are asking.
