Can I sue?

Answered by attorney Stephen Arnold Black
Personal Injury lawyer at The Law Office of Stephen A. Black
It sounds like you have a case. You would have a better case if you have long-term impairment based upon what you stated that being the ugly scar on your leg. You should retain an attorney here in Florida on contingency fee, which means you don't pay anything unless you win. You should go back to the restaurant and take a photograph of the dangerous condition that caused your damages, and also take photographs of your injury throughout the healing process. This website prohibits us from soliciting your case but you can reach out to one of us privately.

Go consult with a workers compensation lawyer for him (or her) to discuss at length with you the circumstances surrounding your accident, to see if there possibly is a third party claim of some nature.

Is it true that for my PI case, I could file the complaint myself?

You can file the lawsuit yourself. You can file a motion for summary disposition yourself. Judge would not hear the motion nearly that quickly, and instead would allow both sides to conduct discovery. Very likely the defense attorney would also file a motion for summary disposition, arguing that your injuries weren't serious enough to meet the statutory threshold. I cannot stress too much how important it is for you to consult with and hire an attorney. The chances of you doing this successfully yourself - and I sincerely mean no disrespect - are virtually zero. There are just too many procedural tripwires and other things that make it nearly impossible for anyone to do on their own.
