It is illegal to record a conversation without permission. If the person 1 informs person 2 that he/she is going to record what is said, continuing to speak can be considered person 2's permission to record.? It is up to person 2 to say, "No, I don't give you permission to record me"then quit speaking until the machine is shut off. If person 1 didn't mention that he was recording until well into the conversation, then everything up to that point was illegally recorded. You need to tell your defense attorney the truth. It may make them settle the case faster and the whole issue fade away. It is illegal to lie to an officer when he is doing his job. See CVC 31. It is a misdemeanor which carries 6 months in jail and $1,000.00 in fines.
