If my friend got rear ended and he has insurance but no license, can he still claim and if he does, can he go to jail?

Yes he can file a claim. Going to jail is unlikely. Even if he gets charged, driving without a license is usually a pay fine.

Insurance will not cover an intentional act, so it may be a tough case to collect on. I would be happy to discuss with you.

If Babra is in a mental institution, probability is he/she has no money. Martin can file a lawsuit and possibly get a judgment, but will not likely be able to collect.
