You want your cake and eat it too. you are lucky the city has insurance. If they did not you could not recover. The insurance co owes you only the fair market value of your car. if it costs more to repair than the car is worth on the market you only get FMV if you want to keep the car, you must agree with the carrier to settle with them and buy back your car as salvage (at salvage value) and then fix it if you want to. You don't threaten cities and insurance companies to do things your way or else. They don't care about your threats.
