About Benjamin A. Webster

Mr. Webster is the co-managing partner of the Morgan & Morgan Business Trial Group and a trial lawyer who specializes in handling business litigation on a contingency fee basis. Mr. Webster is a Board-Certified Specialist in Civil Trial Law. To obtain board certification, lawyers must pass a comprehensive examination that evaluates their knowledge, skills, and expertise in a specialty field. Board-certified lawyers also undergo a rigorous peer-review process that assesses their competence in the specialty field, as well as their professionalism and ethics in the practice of law. Over his career, he has seen many individuals and businesses with significant claims unable to access the civil justice system or properly pursue their claims due to the inability to pay the attorneys’ fees required by the traditional hourly fee model.

At Morgan & Morgan, Mr. Webster provides representation to clients involved in business disputes on a contingency fee (success fee) model, which allows his clients to obtain the best and most efficient results possible, regardless of their financial position. Using the success fee model, he has recovered tens of millions of dollars for his clients through jury verdicts and settlements. In particular, Mr. Webster has first-chaired several trials and obtained a number of significant jury verdicts for his business clients.

Mr. Webster’s practice is currently focused on professional liability claims (such as legal malpractice, accounting malpractice, auditor malpractice, and engineering malpractice) and claims for unpaid commissions (such as real estate commissions, recruiter commissions, and sales commissions). While professional liability and commission claims are the current focus of his practice, Benjamin also has years of experience handling a variety of other types of complex commercial cases, including those involving business torts, contract disputes, partnership disputes, real estate related litigation, construction defect or payment disputes, investor fraud, and others. He has extensive experience litigating these and other types of complex cases from inception through trial and verdict, in several state and federal trial courts, as well as in the Florida appellate courts and in the U.S. Court of Appeals for the Eleventh Circuit.

Prior to joining Morgan & Morgan, P.A., Benjamin practiced for several years in the national law firm of Baker & Hostetler, LLP. Benjamin has been named a “Rising Star” by Florida Super Lawyers magazine, an annual publication that recognizes the top 2.5% of the state’s young lawyers, for many years. Benjamin has also been named as one of “Florida’s Legal Elite” by Florida Trend on multiple occasions - a designation awarded to attorneys by their peers, which is given to less than 2% of attorneys in the state of Florida.
