I hired Tom Fleischer to file court papers for a quit claim on property after divorce. This was handled okay but very slowly and with minimum communication from Fleischer. Approximately 6 years later, I hired him to file affidavits of heirship so my sister and I could inherit my parents homestead after they passed away. I paid up front and expected services to be completed within a few days as promised. I tried to contact him several times. Several days later, I finally connected him and found the papers had not been filed. He promised get them filed in a day or two. After two weeks, I called again. This went on for a few months - no communication from him and not answering my calls or emails. So I looked on the State Bar website and found that his license had been suspended for almost a year. At that point, I sent him a certified mail (and email) letter to get the papers filed or I would look into legal action against him to get my money back. He finally filed the papers.
I hired Tom because I was defrauded out of $36,000.00 from a company in Utah (owner of the company is now on criminal trial for fraud). I came to Tom to help me get my money back. We started a retainer system. Tom created an affidavit on my behalf, stated he was in communication with the fraud person's lawyer (which was a lie) but couldn't/wouldn't produce proof of this. With no response from the client, he stated he was going to go in front of a judge personally to get a local judgement, as this case was in UTAH. This continued for a few months, until Tom stated he was going to see a judge in person to hand over my affidavit and get the judge to make a judgement. On the day he stated he was going over there, Tom stated that he got judgement on my behalf and I was going to get refunded. I asked Tom to present the judges ruling, which he never delivered. Once he didn't deliver, I search the courts database for the proceedings and found out it never happened, he lied about it all.
