About Samuel J. Miller

Samuel J. Miller is an experienced trial attorney who litigates in all state and federal courts in Massachusetts. He has experience representing individuals, partnerships, employers, and employees in a wide variety of disputes and is frequently engaged as lead counsel in complex civil litigation.

In addition to representing both employers and employees, Sam has experience representing closely held businesses, attorneys and law firms, and commercial landlords and developers. He focused his practice for years on many types of business disputes, particularly those involving partnership and close corporation dissolutions and shareholder derivative litigation.

Sam also has substantial experience representing individuals harmed by the negligence of others. He has represented individuals in a variety of types of negligence cases, including premises security cases, products liability cases, and medical negligence cases. For over three years, he specialized in representing the families of children born with brachial plexus injuries around the country and recovered millions of dollars for those children and their families.

Litigated and negotiated a favorable settlement for whistleblower employee fired with information as to employer’s violation of consent decree with governmental agencies.

Obtained summary judgment for commercial developer in dispute over commercial loan with credit union, preventing credit union from attempting to collect almost $1 million it argued were owed

Obtained dismissal of a complaint against a salesperson sued for wrongful death involving a glider crash. Took part in a ten-day trial that resulted in a $3.2 million jury award for a commercial developer over a credit union’s failed attempt to fund the development of a hotel.

Took part in a nine-day trial that resulted in a $1.8 million jury award on behalf of a child with a brachial plexus injury due to the negligence of the delivering obstetrician.

Negotiated a favorable settlement for minority shareholders of a food importing business two weeks into a three-week trial based on claims of fraud, breached of fiduciary duty, and wasting of corporate assets by majority shareholder to fund personal expenses and purchase luxury real estate in the Caribbean.

Litigated and negotiated a favorable settlement for homeowner sued by contractor sued for stopping the contractor from completing work on a home addition due to the contractor’s negligence and shoddy work.

Sam attended Simon’s Rock College of Bard and earned his Bachelor of Arts Degree summa cum laude in Political Science from the University of Massachusetts – Boston where he won a Political Science department award. He graduated cum laude from Suffolk University Law School in 2009 where he was the Production Editor of the Journal of Health and Biomedical Law.

Sam is admitted to all state courts of the Commonwealth of Massachusetts and the United States District Court for the District of Massachusetts. Additionally, Sam has litigated on behalf of clients in over 20 states and has taken cases to verdict in numerous states.

Sam lives in Brookline with his wife and son.
