Mr. Valitutti co-heads the firm’s birth trauma defense practice and serves as national counsel for insurers and major health systems in birth trauma cases in almost every state in the country. In almost four decades as a litigator with the firm, he has served as first chair in more than 70 trials. Mr. Valitutti is licensed to practice law in Michigan, as well as the U.S. District Courts of Eastern and Western Districts of Michigan and the Sixth Circuit Court of Appeals. He is also active in multiple professional organizations.
After many years of successfully defending medical malpractice and product liability cases, Mr. Valitutti pioneered the development of a process that is designed to identify those issues which favor the defense and are ignored purposefully, typically in large damage potential cases. This includes strategies that seek to bring more of the truth about future damages before jurors than others. Recognizing the defendant has a burden of proof on the issues of damages in catastrophic injury cases, Mr. Valitutti on showing the actual cost of future care is catastrophic injury as opposed to what is black boarded (claimed). Using this strategic capability, he coordinates the defense of catastrophic actions nationwide and, is often asked to share responsibilities with local counsel in the development of examination of frequent testifiers, successfully defending cases to verdict.
Mr. Valitutti is AV Peer Review Rated 5/5 by LexisNexis/Martindale-Hubbell. Mr. Valitutti holds the honor of being a fellow of the Litigation Counsel of America Trial Lawyers. He was also recognized as a Top Ten Lawyer for American International Group (AIG), one of the nation’s largest insurance and financial organizations.
Mr. Valitutti has been named a Michigan Super Lawyer.Only five percent of the attorneys in the state are named Super Lawyers. He was also recognized in DBusiness Magazine 2013 - 2017 and 2021 as a Top Lawyer in medical malpractice and professional liability. He has been recognized by Best Lawyers in America as a “Best Lawyer” in the field of Medical Malpractice Law: Defense and was recognized as “Lawyer of the Year” for the 2022 edition. He was also recognized as a Leading Lawyer in 2021 and 2022. This recognition is based on a survey of their peers.
Mr. Valitutti is a frequent lecturer having spoken before such organizations as the (DRI) Defense Research Institute, The (ACOG) American College of Obstetricians and Gynecologists, The (ACI) American Conference Institute, and the Annual Conference on Obstetrics, Gynecology, Perinatal Medicine, Neonatology and the Law and major excess insurers based in the United States and offshore.
