Representative Cases & TransactionsCasesSignificant Representative Matters: Successfully presented oral argument before the New Jersey Appellate Division in a case involving the statute of limitations
New Jersey's discovery rule. At the trial level the defendants successfully obtained a grant of summary judgment in favor of our client, a board certified transplant surgeon, finding plaintiff violated the New Jersey statute of limitations in waiting to join our client by way of an amended complaint. The Appellate Division affirmed the trial court's grant of summary judgment.
Obtained a unanimous jury verdict defending an obstetrician/gynecologist. Plaintiff alleged negligence when the defendant physician left a needle in her uterine wall following completion of a cesarean section delivery. Plaintiff sought damages in connection with emotional trauma of having a needle inside her for 13 months, as well as having to terminate a pregnancy that occurred eight months after the alleged negligent act. Through expert testimony, the defendant argued the retained needle posed no threat to the subsequent pregnancy. The jury returned a unanimous verdict in favor of the defendant in less than one hour.
