Mediation - Solutions That Make Sense
Divorce Mediation offers families an affordable and sensible alternative to litigation. A mediator helps facilitate communication and conflict resolution as a neutral party who can give information, but not legal advice. Mediation allows the parties to craft a creative resolution themselves without litigation. The ultimate goal is to reach a binding settlement of the issues in dispute through open discussion and the exchange of information.
While our mediators are attorneys, when they act in the capacity of a mediator, they cannot offer either party legal advice or act as either party's legal counsel. As a mediator, our goal is to keep the discussion focused, open the lines of communication, and coach both parties through the decision-making process. Graham Mediation utilizes both a facilitation and evaluative style with their mediation clients.
Collaborative Divorce
Collaborative divorce is a fairly new alternative dispute resolution technique. It involves two separate specially trained attorneys. This is different from mediation, which employs only one mediator. Both parties sign a contract declaring they will resolve their family issues outside of court and without litigation.
The collaborative divorce process consists of joint meetings of all parties where legal advice is given with a sense of parity and with a goal of an amicable resolution. The common goal is to reach a fair resolution for all parties involved.
A collaborative divorce is often less expensive then litigation because there are fewer steps to the process and no court fees are required. A collaborative divorce is often a quicker process and gives the parties more control of the ultimate outcome.
