You can apply for adjustment of status to permanent residence. In other words, he can apply for his green card once he marries you! This process only takes 3 months and there is no penalty for overstaying : ).

Obstacles: How you entered the United States. If illegally, then the issue is going to be whether or not you qualify for 245i of the Life Act. If not, then you will be looking at the need for a waiver and a return to your home country. Please note, consulting with an experienced immigration attorney will go a long way in clarifying what if any relief is available to you.

Can someone stay in the U.S if his residency status is expired and has a drug felony charge?

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
Relief may be available in the form of cancellation of removal, depending on the nature of the allegations in the notice to appear and the details of the drug charge.  Every case is different and should be evaluated by a competent attorney.  Since he was wise enough to hire a good attorney for his criminal case, he should also hire an attorney to represent him in this immigration matter.  Please contact me if I can be of any assistance.
