What If Applicant is denied a US Immigration visa can his child enter if approved?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The answer depends upon whether the visa applications are separate standalone applications or whether the child is filing under a dependent status. If the first, he or she may be able to receive the visa without you; if the second, he or she must await your result. If I petition I-130 for my brother in the Philippines, how long is the waiting time?

Answered by attorney Carlos Raul Juelle (Unclaimed Profile)
Immigration lawyer at Herrera & Juelle LLP
It will take 1-2 years for the approval. However, they are currently processing for an immigration visa beneficiaries whose visa petition was filed on or before April 22, 1990. As such, your brother and his family would be waiting a long time, perhaps 24 years or more, until he and his family could immigrate to the United States. Any children included in the petition would likely turn 21 and age out of the petition.

What should I do if I have petitioned for my minor children from Jamaica on April 2012 as a permanent resident but has had no answer?

Answered by attorney Jeffrey N Lisnow (Unclaimed Profile)
Immigration lawyer at Law Office of Jeffrey Lisnow
This can NOT be answered without a detailed analysis of what was done and a review of the documents that were submitted. An error that was done when the papers were sent in will result in a long delay. You will be best served to have an attorney review your case. Many of us, such as myself, will do telephone consultations.
