What is my immigration status if I do not return to the US ship after leave is up?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
A C1/D2 crew member must return to their ship. They cannot adjust status, nor seek relief for the most part. A person who overstays a C1/D2 can be deported They usually have no right to adjust status even if they marry a U.S. Citizen. It is best to consider consular processing and leave with the ship. Should negotiation be needed, you may need an experienced Filipino licensed attorney who practices Filipino maritime or armed forces law. There has only been one exception in the history of immigration law. However, if you were not petitioned directly or indirectly for an immigration visa by January 14, 1998, then you cannot do much. I strongly recommend an appointment or teleconference to consider all of your options.

I have H-1B visa untill 2019 so If I apply for Asylum will this effect my H-1B visa status. I mean will my H-1B visa be canceled or not?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you have a legal nonimmigrant status like H-1B, your applying for political asylum will not cancel the H-1B status. In applying for asylum while in status, you will only have one chance to prove your case for asylum. That will be at the local asylum office. If your case is denied, you will receive a notice of such action, but U.S.C.I.S. will take no steps to cancel your status or to put your case before an immigration court. Can my husband obtain a green card with a domestic battery conviction from 14 years ago?

Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
That one conviction is not likely to be a problem; but what is his current immigration status? That is the bigger issue as he may need to apply for an immigrant visa at his home consulate.
