A second marriage is valid only if the previous marriage first was terminated through divorce, annulment or death. For someone with an invalid second marriage, it may be appropriate to obtain a divorce to terminate the first marriage and then have another wedding for the second marriage - it would be wise to consult with an attorney who, upon learning all of the relevant information, could provide specific advice for your situation and provide legal representation for a marriage-based immigration application. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

You may read the instructions about how to apply for the tourist visa on the embassy website. Your girlfriend must be prepared to prove to the consular officer that she will not work while she is in the U.S. and that she intends to return to her home country after her stay in the U.S.

As a US citizen, you can petition for both your parents and brother from France to immigrate to the US. The petitions are filed on form I-130. It normally takes about 1 year for the paperwork to be processed before your parents will have their visa interviews scheduled at the US consulate. It's currently taking about 13 years for siblings of US citizens.
