Do we need to hire an attorney to get the green card?

You do not "need" an attorney to file the necessary paperwork. However, if you want it done as efficiently as possible and avoid any mistakes or delays, it is a good idea to have an experienced immigration attorney assist you in the process.

Can we start over with our AOS application and try to get a 10 year green card instead since my wife and I have been married over 2 years?

You can do an INFO PASS appointment to speak to an immigration officer. But it is probably easier just to refile the case with an attorney.

Can I apply again if I was denied naturalization?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Yes you can absolutely apply for naturalization again but fraudulent marriage finding is serious so should be evaluated properly. Was the fraudulent marriage finding related to your current marriage or a prior marriage? If a prior marriage it is this relationship which will need to be proven to be real and just one that did not work out. Technically it is USCIS who must prove fraud but the burden is on you to show a good faith marriage.
