Can I sponsor my husband if I am unemployed?

First, if you are entitled to any unemployment compensation, you should receive it, even if it is small and would not reach the poverty guideline. The difference can be covered by your family assets (money in retirement funds, savings accounts, investment portfolios, etc.; value of your real estate, cars, jewelry, etc.; value of a life insurance policy if it can be borrowed against, and other financial instruments) so long as the combined value of the assets is more than 5 times the shortfall between your income and the poverty guideline. For example, if your unemployment (or the unemployment plus income from a part-time work you can take without losing the right to get the unemployment) is $9387 a year, you need to show $50000 in assets on the I-864 Affidavit of Support ($19387 poverty guideline minus $9387 income, times 5). While your husband's income can be counted on the affidavit of support only if he will continue to receive it after becoming a permanent resident of the U.S., all the family assets are countable, even if they are located outside the U.S. Since you indicated that your husband earns enough to provide for both of you, he might well have sufficient assets. If not, you need a co-sponsor who would agree to sign a separate affidavit of support. The co-sponsor does not have to be a relative; all that's required is that he/she must be a U.S. citizen or permanent resident, and have income and/or assets equal or exceeding the poverty guideline applicable to the case (for instance, the co-sponsor who has 2 dependents would have to show income of over $29437 a year).
