My sponsor wants to sponsoring and another person?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
I assume that you are talking about an I-864 affidavit of support. Under the poverty guidelines for 2015, a couple without children or other dependents and who has sponsored no others in the past, is able to support 8 people under the 125% guideline used in immigration cases. So if she and her husband are 2, and you and another person are another 2, that would only be 4 people – a number able to be supported with the income of $54,000. What do I do if I have a student visa and overstayed?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
If you are marrying a US citizen your overstay will be forgiven. Do not travel until you obtain permission to do so. You really should consult with an immigration attorney before filing any paperwork to protect your status.

If I get married and help my husband gain legal status can I still help my father gain legal status at age 21?

Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
Yes, but getting married is no guarantee of getting permanent residence for your husband. He must qualify to get the green card as well. Same thing for your father. Both of these qualify as "immediate relatives" for immigration purposes.
