Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. (S)he would then be in a better position to analyze your case and advise you of your options and, if possible, make sure that the necessary paperwork and documentation is presented so as not to delay the process.

Can you get married in the US if you are still married in a foreign country?

Answered by attorney Sufen Hilf
Immigration lawyer at Hilf & Hilf PLC
For US immigration authority, if she obtained a divorce decree here in the US, then she is divorced. You can definitely marry her, having a legal marriage. However, whether the government of Ecuador recognized the US divorcee decree, I am not sure. I guess it does not matter if there are immigration benefits to be sought, as long as she is divorced here.

How long can I get a work permit for a non-resident since my green card is pending?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
It is unclear whether you are eligible for work authorization. You must be able to qualify for adjustment of status. If you are out of status or an overstay, then this complicates matters. I strongly recommend an appointment or teleconference with a competent and experienced immigration attorney.
