Will a marriage to an illegal affect my residency and immigration process?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
No, marriage to an illegal will not jeopardize your pending process UNLESS the category you are in requires you to be unmarried. Under some categories your spouse can benefit as well.

With the new policy, what are the chances of him getting residency when we marry?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
First of all, he may be eligible for relief under DACA if he finished high school, has a GED or served in the military. That provides two years of ability to work, he can get a SS# and potentially renew in two years. There may be other options currently available, maybe 245(i) but you really need to seek a full consult with a competent immigration attorney; NOT a notario to determine eligibility. If he has any arrests, this can be an issue. In terms of the new laws introduced in Congress, these are not final until passed- so watch the news to see if they do. And call your congress people to express support of them. He may be able to file for a green card under the provisional waiver law, wherein you can file a green card application for him as a spouse/fiancee. However you then need to prove you will suffer extreme hardship if he is not allowed to remain in the US. It is very important that you do not try to determine answers just on websites but please seek counsel that is competent in this field. If you do not have a lot of money, try the local chapter of the state bar for pro bono or low fee attorneys- there also may be non-profit orgs that provide assistance. Good luck!

Yes, a spouse can file at any time for their qualifying step-children, and does not matter, typically, who is in which country.
