Does my fiancée need to leave the country even if I am marrying her here in the US?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
If she is here and has entered in a legal status and you get married, then assuming you are a U.S. citizen her green card can be obtained without leaving the U.S. in most cases. To properly advise would also need to know if previous overstays, any criminal record, etc.

If I falsely declared that I was an american when I was 15 years old in the boarder will this affect the process of taking out residence?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Your story is strange indeed as the penalty for misrepresenting oneself as a US citizen is a lifetime bar. It is more likely that the border officers decided to scare three girls by unilaterally stating penalties of three and one year. I suspect that none of this was officially put on anybody's record. So I doubt that you would ever have a problem with this encounter when you are interviewed for permanent residence based on your marriage to a US citizen. What are the chances of the ban not being implicated?

default-avatar
Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
As long as he only has one illegal entry into the U.S., he should qualify for a waiver of the 10-year bar. The waiver is filed with USCIS on form I-601, and he must establish that you would suffer extreme hardship if his waiver application was denied.
