I want my son to migrate here in USA from my approved petition when he is child

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Is there a problem? As a naturalized US citizen, your child’s age is frozen as of the date that your petition is filed with USCIS. In other words, if your son is 20 and you filed the petition today, your son’s age remains under the age of 21 for purposes of his immigration case and he remains a child. I also note that this type of case typically takes about a year. Can I petition for my wife if she came to the US under a different name?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
That is a very complicated situation. My understanding is that in most jurisdiction, entering on a fake name means that legally you were never admitted to the US. This makes it very difficult to apply for or obtain a green card. You need to make a consult with a competent immigration attorney to fully analyze this case, in particular to look at the current holding in your jurisdiction. The daughter's case is separate- since you are legally married you can sponsor your step daughter. However that will probably raise questions about your wife so again, use that consult!
