Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated.

For the immigrant spouse: Bring the passport, i-94 used to enter the US. Bring all immigration documents (forms, receipts, approval, denial, work permits, etc...) filed with / received by the INS / USCIS/ EOIR, etc filed by your spouse or by her / his parents if your spouse was under the age of 21. Bring any / all certified court disposition for any / all criminal matters, even if case was expunged or dismissed. Bring any proof of termination of previous marriages - even if it was 50 years ago. Certificates of birth of your spouses + all certificates from her children. The US citizen spouse should bring: any criminal records having to do with criminal conviction involving harm to children, all proof of termination of previous marriage, proof of US citizenship (birth cert if born in the US, US passport or nturalization certificate). What if we file for divorce after we get EAD or after we get EAD and GC?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
You only get these benefits because you are married. So if you divorce, then you are no longer eligible for the green card. There is an argument that your EAD card is not useable and an argument that it is, until DHS terminates your I-485 application. If you file for divorce first, there is a real question at to whether you should retain the benefits as well. This can come back to bite you in later applications. See a competent immigration attorney to fully discuss what is happening in your marriage (are you 100% getting divorced, or just having a hard time, etc.), the options, risks and ramifications.
