Are there any consequences against me if I do not marry my fiance who is here on a fiance visa that has expired?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
No consequences to you so long as you brought her here in good faith. She needs to leave at the end of her K-1 time. If she marries someone else she is required to process her papers abroad so it is important she not overstay the K-1 or else she will need an expensive waiver as well.

Can an immigrant stay in the united ststes if they marry a u s citizen and the citizen drops all support for their green card for leaving the marriage

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Unless the individual has some other legal status to remain in the country, she would not have any legal status to remain in the country following the cancellation of application papers for immigration based upon the marriage. That being said, there are approximately 11,000,000 undocumented immigrants in the country. She may also be able to find another way to immigrate, especially if she has the support of someone who just won $378 million in a lottery. How will long will it take to petition my daughter if I am a US citizen and my daughter is in Pakistan?

Answered by attorney Mary Lyn Tanawan Sanga (Unclaimed Profile)
Immigration lawyer at Law Offices of Mary Lyn T. Sanga A Professional Corporation
Based on the October 2012 visa bulletin, the priority date for F-3 category (married sons and daughters of US citizens) is May 22, 2002. This means that the USCIS and/or NVC will process visa applications with priority date of May 22, 2002 or earlier. The priority date is the date the petition was filed, so this category is about 10 years backlogged.
