Is there a way of getting back to the States 5 years after being Deported?

default-avatar
Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
Exactly why were you deported? Was it because of the criminal case? Was it because you were here illegally? Exactly what happened during the removal/deportation proceedings? Were you ordered removed by a judge or did you self-deport? Without the answer to these and many other questions, it is impossible to properly answer your question. I strongly suggest that you or your wife in the U.S. contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze you case and advise you or your wife of your options.

Will age difference affects getting an immigration visa?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
Obviously, age does make a difference for the purposes of evaluation of the bona fides of a marital relationship for the immigration officers. You obviously are considering this issue otherwise you would not have provided this query online. It is best if you have a situation like this to be sure that you have other evidence that clearly document the bona fides of the marital relationship between you and your husband. It is not to say that an age difference is dispositive of a fake marriage, it is only that it is best for you to provide additional evidence, beyond what normally would be required to demonstrate the bona fides. If you should have additional questions or desire the services of our immigration law firm, please feel free to reach out for us at any of the numbers below.

Can I become a permanent resident if I am living with my permanent resident parent?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
If you are unmarried your dad can file the I-130 now. Otherwise he can do this when he is a USC. It will then take many years until you are able to file for your green card. UNless you have eligibility under 245i, you will not be allowed to adjust in the US because you are not considered an immediate relative under the law. So you will need to apply at the US consulate in your home country. THis will trigger a ten year bar and I don't believe there is a waiver for this (father to son). So please have a full consult done with a competent immigration attorney to fully dig into the specifics of your case. There may also be some weird claim of USC or other avenues for you, depending upon your mother's history and others.
