Can my husband get his visa denied?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
He may be charged with unlawful use of a SS# or card, if that was not his number. However this will not necessarily bar him from obtaining a green card via his marriage to you. But you really need to have a full consult with a competent immigration attorney so you can have his case and issues fully assessed.

Would I qualify to the Reform even if I am in Mexico?

Evelyne M Hart
Answered by attorney Evelyne M Hart (Unclaimed Profile)
Immigration lawyer at Hart Immigration, A Professional Law Corporation
If you were out of status for more than one year, when you left for Mexico, you triggered the 10-year bar.  You state that you had an overstay of 73 days and when you left for Mexico, you then triggered the 3-year bar.  You will need to stay in Mexico for 3 years (provide proof of this when you reapply for another H-1B visa or another benefit).  You do not mention facts that would make you eligible for a waiver, such as having U.S. Citizen or Lawful Permanent Resident parents or spouse.   I'm not sure which reform you are asking about but the 3-year bar still exists.

Do I have a chance to petition for him or will he automatically be denied if he was still on trial and he left the country?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. If he was on trial for a criminal offense when he left, there is a good possibility that there is still an outstanding fugitive arrest warrant in the system.
